Sharkitect Digital LLC ("Sharkitect Digital," "we," "us," or "our") operates the website sharkitectdigital.com. This Privacy Policy explains what personal information we collect, how we use it, and what choices you have.

When you submit our intake form at sharkitectdigital.com/get-started, we collect the following:

  • First name
  • Last name
  • Email address
  • Phone number
  • Your role in your company
  • Company name
  • Service industry
  • State
  • Your response to "Which of these is costing you the most right now?"
  • Your response to "What's your biggest business challenge?"
  • Your response to "If you could eliminate one repetitive or manual task in your business tomorrow, what would it be?"

Information Collected Automatically

When you visit our website, certain information is collected automatically through cookies and similar technologies:

  • HubSpot tracking cookies: Pages you visit on our site, time spent on pages, referring website, browser type, device type, and general geographic location (city/region level, not precise location)
  • Google reCAPTCHA: When you submit our form, Google reCAPTCHA collects certain data (such as browser and device information) to verify that you are a human visitor. This data is subject to Google's Privacy Policy and Terms of Service.

Analytics Services We May Add

We may implement additional analytics tools in the future, including Google Analytics 4 and email marketing platforms. If we do, we will update this policy accordingly. Any future analytics tools will be used solely to understand how visitors interact with our site and improve our services.

  • To send SMS messages — Only if you have opted in via our SMS consent checkbox. These messages are limited to scheduling, reminders, project updates, and support. We do not send marketing or promotional text messages.
  • To improve our website — Understanding how visitors use our site so we can make it better.
  • To prevent fraud and abuse — Using Google reCAPTCHA to protect our forms from bots and spam.

What We Do Not Do

  • We do not sell your personal information. Not to data brokers, not to advertisers, not to anyone.
  • We do not share your information with third parties for their own marketing purposes.
  • We do not use your data for automated decision-making or profiling that produces legal or similarly significant effects.

 

3. Third-Party Service Providers

We use the following third-party services to operate our business. These providers only have access to your information as needed to perform their functions and are obligated to protect it:

4. SMS Communications

If you check the SMS consent box on our form, you are authorizing Sharkitect Digital to send you recurring automated informational text messages at the phone number you provided.

What you need to know:

  • Message types: Scheduling, reminders, project updates, and support only. We will never send marketing or promotional texts.
  • Consent is not required to purchase any service from us.
  • Message frequency varies based on your service engagement.
  • Message and data rates may apply depending on your mobile carrier and plan.
  • To opt out: Reply STOP to any text message from us.
  • To get help: Reply HELP to any text message from us, or contact us using the information in Section 12.

We comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations governing SMS communications. We will not send text messages to anyone who has not provided explicit consent.

 

5. Email Communications

When you provide your email address through our form, you will receive an automated follow-up email sequence. This sequence consists of no more than four emails: an initial confirmation and up to three follow-up messages. These emails are sent to coordinate your Operating Efficiency Report and discuss whether our services are a fit for your business.

Once you respond and a business relationship begins, all communication switches to one-to-one outreach from Christopher Sharkey directly. You are not added to any ongoing newsletter, promotional list, or automated marketing sequence.

Your email rights:

  • You can opt out of the follow-up sequence at any time by clicking the unsubscribe link in any email.
  • You can also contact us directly to request removal (see Section 12).
  • We honor all unsubscribe requests promptly and within 10 business days as required by law.
  • Transactional emails related to an active service engagement (such as project updates) are not marketing communications and are not affected by unsubscribing from the follow-up sequence.

We comply with the CAN-SPAM Act. All emails from Sharkitect Digital include our company name and a clear way to opt out.

 

6. Cookies and Tracking Technologies

What Are Cookies?

Cookies are small text files stored on your device when you visit a website. They help websites remember information about your visit.

Cookies We Use

HubSpot tracking cookies:

  • __hssc — Tracks session activity. Expires after 30 minutes of inactivity.
  • __hssrc — Determines if the visitor has restarted their browser. Session cookie (deleted when you close your browser).
  • __hstc — Tracks visitors across sessions. Expires after 13 months.
  • hubspotutk — Tracks a visitor's identity. Expires after 13 months. This cookie is used to connect your form submission to your browsing activity on our site.

Google reCAPTCHA cookies:
Google reCAPTCHA may set its own cookies to function properly. These are governed by Google's Privacy Policy.

How to Manage Cookies

  • Active service engagements: For the duration of our business relationship and a reasonable period afterward.
  • Service inquiries that do not result in an engagement: Up to 24 months from your last interaction with us, after which your data will be deleted or anonymized.
  • Analytics data: HubSpot analytics data is retained in accordance with HubSpot's data retention policies.

If you request deletion of your data (see Section 9), we will process that request promptly, subject to any legal obligations that require us to retain certain records.

We take commercially reasonable measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Use of encrypted connections (HTTPS/TLS) on our website
  • Restricting access to personal information to authorized personnel only

Our website and services are not directed at children under the age of 13. We do not knowingly collect personal information from children under 13.
